A class action is a representative proceeding brought by one person on behalf of a group of people to assist in resolving common issues & factual disputes amongst that group. The main benefit of group proceedings is that they enable a dispute involving potentially large numbers of people to be resolved by way of a single case. Advantages of a Class Action can include increase efficiency of the legal process together with lower costs of litigation.
If you are a Health Practitioner and feel aggrieved as the result of AHPRA’s behaviour or related parties please contact us to discuss joining our Class Action. For example, if you believe that AHPRA has been negligent in their Duty of Care to protect you from vexatious allegations and/or party to those allegations.
Our Class Action aims to seek financial compensation for those who have been unjustly & maliciously harmed, both professionally & personally, as a result of the actions of AHPRA & associated bodies.
We also aim to have all unsubstantiated allegations & unjust findings against Health Practitioners removed from the internet & from wherever else they have been published.
Currently Senators involved in the 2017 AHPRA Inquiry are proposing that Health Practitioners who endure AHPRA investigations based on vexatious complaints receive financial compensation. While such proposed changes will be greatly welcomed we believe that they are far too late and possibly far too little. AHPRA & associated bodies must be held accountable now. As stated by Senator Xenophon, during his investigation into AHPRA, “justice delayed is justice denied”.
“AHPRA is a body corporate with perpetual succession, has a common seal, and may sue and be sued in its corporate name.” See https://www.ahpra.gov.au/
Disciplinary action taken by AHPRA against anyone based on false and misleading complaints (with hidden secondary agendas) constitutes a form of miscarriage of justice and for which AHPRA will be made accountable for their actions under our Australian rule of law.
Currently we are suggesting those practitioners who are being bullied & harrassed by AHPRA to consider lodging an Application for a Judicial Review at the Supreme Court.
