I strongly believe that the vexatious complainants are not investigated properly and not penalised.
I wish to give a background of my story:
- In October 2016, an anonymous call received by AHPRA that I have been charged with the sexual assault. AHPRA investigated immediately and closed the case as there was no basis but kept that on file.
- In January 2017, I received a notification from AHPRA that I inserted a vaginal mesh during the prolapse repair as per the patient’s complaint. This case was instigated by a GP Dr. Eileen Bristol and the Gynaecologist Dr. Michelle Atherton. When AHPRa asked for Dr. Atherton’s report, she denied that she told the patient that I inserted vaginal mesh. After 12 months, the case was closed as there is no basis for that. The complainants (the Patient, the GP and the specialist) had instigated the patient to complain were given no warning or anything.
- In March 2017, another notification was sent by AHPRA on the basis that during routine hysterectomy, I broke the patient’s left thigh muscles. The patient complained to AHPRA instigated by the GP Dr. Renuka Rasasinghe. This was proved malicious after 2v years of investigation and was cleared by AHPRA. But no action was taken against the GP and the patient.
- In June 2019, I received a notification from AHPRA that I have made an inappropriate breast examination on a patient which was not clinically indicated and chaperone was not present. Chaperone confirmed that she was present and the examination technique and it was clinically indicated as per AHPRA expert’s opinion. However, AHPRA still put conditions on my registration with a practice monitor. The background to this complaint is – Patient came for a second opinion as she was not happy with the first specialist (Dr. Aseel Alkhiat) as she recommended hysterectomy. I saw this patient and advised her to try alternative before contemplating hysterectomy. However, this patient went back to check with Dr. Alkhiaat. Dr. Alkhiaat was not happy with my advice, however she advised the patient to complain to the police as breast examination was not indicated and sexually motivated. Obviously police investigated and closed that case with no action but referred to AHPRA.
- In December 2019, I received a notification from AHPRA that I did a vaginal examination after the Practice Monitor left the curtained area. The Practice Monitor confirmed that it was unfounded and untruthful by her internet logging and as per witness statement. This is purely vexatious however AHPRA suspended my registration. This is draconian and unreasonable. This case is coming for a hearing at the State Administrative Tribunal in February 2021
All these complaints are vexatious. Although the first three cases are dismissed by AHPRA but they bring them for cases 4 & 5 investigation process.
Now the local newspaper already published in a vexatious way – please see the attached. This caused irreversible damage to my reputation.
The whole process by AHPRA is unreasonable and draconian and very damaging. I am wondering this organisation is run by criminals.
Apparently AHPRA is protected by the so-called National Law.
